Terms of service
Last updated
These terms are an agreement between you and Kaine Ventures, LLC, which provides My Stuff (“we”, “us”). They apply when you use the My Stuff iPhone app (on the App Store as “My Stuff: Scan, Price & Sell”) and this website. By creating an account or using the app, you accept them. If you are a consumer, nothing in these terms limits the rights you have under the mandatory law of the country where you live.
Who can use it
You must be at least 13 years old to use My Stuff, and if you live in the European Economic Area, old enough to consent to online services under the law of your country. If you are under the age of majority where you live, you need a parent’s or guardian’s permission, and they accept these terms for you. My Stuff is for personal use.
Your account
You sign in with Apple or with your email address, and your account holds your inventory across your devices. Keep your sign-in secure: you are responsible for what happens in your account. You can delete your account at any time in Profile → Settings → Delete Account and All Data, which permanently deletes your data as described in the privacy policy.
The service
My Stuff identifies the items you photograph, estimates their resale price range from comparable listings, keeps your inventory, and drafts marketplace listings for you to copy or share. It runs on iPhone with iOS 18.5 or later, needs an internet connection, and analyzes items on our servers with AI models from third-party providers, as the privacy policy describes. Features may change as My Stuff improves; if we remove something you paid for in a way that matters, you can cancel.
Estimates are not appraisals
My Stuff price estimates are automated guidance based on public listings and AI analysis. They are not professional appraisals, they are not meant for insurance, tax, legal or estate purposes, and they are not offers to buy. An item may sell for more or less than its estimate. An identification can be wrong, and the comparable listings come from third-party websites that we don’t control. Every estimate shows its range, its confidence grade and the comparables behind it so you can check the work. You decide what to ask for an item and whether to sell it.
Listings and marketplaces
My Stuff drafts listing text: a title, a description, a price and a condition. You review the draft, and you decide whether to post it. My Stuff never posts to a marketplace on your behalf. When you post a listing, you are responsible for it: that it describes the item accurately, that you may sell the item, and that the listing and the sale follow the law and the rules of the marketplace you use, such as Tori.fi’s terms and posting rules. Marketplaces are independent third parties; we are not part of any sale between you and a buyer and handle no payments, shipping or messages between you.
Plans and subscriptions
Free. The free plan includes 10 item scans in total. One scan identifies one item and estimates its resale price, however many photos you add. Re-pricing an item counts as one scan. Writing a listing is free. If an analysis fails, the scan doesn’t count.
My Stuff Pro is an auto-renewing subscription, billed monthly or yearly at the price shown in the App Store before you buy, in your currency and including applicable taxes. Pro includes up to 300 item scans and re-prices a month.
- Payment is charged to your Apple ID when you confirm the purchase. Apple processes all payments.
- Renewal. The subscription renews automatically at the end of each period unless you turn off auto-renew at least 24 hours before the period ends. Your Apple ID is charged for the renewal within the 24 hours before the period ends.
- Cancelling. Open Settings on your iPhone, tap your name, then Subscriptions, and choose My Stuff. Pro stays active until the end of the paid period, and your inventory stays in My Stuff on the free plan.
- Refunds are handled by Apple under the App Store terms; request one at reportaproblem.apple.com. Where the law gives you a right to a refund, that right applies.
- Restoring Pro on a new iPhone or after reinstalling: sign in with the same account and choose Profile → Settings → Restore Purchases.
- Price changes apply from your next billing period, and Apple asks for your consent where the law or the App Store rules require it.
Deleting your account doesn’t cancel a subscription: Apple bills it separately, so cancel it in your iPhone’s settings too.
Acceptable use
Use My Stuff lawfully and for your own items. In particular, don’t:
- scan items you don’t own or aren’t entitled to sell in order to deceive anyone, or use estimates or listing drafts to misrepresent an item, its condition or its value;
- use My Stuff to sell stolen, counterfeit or prohibited goods;
- upload photos you have no right to use, or photos meant to capture other people’s personal information;
- scrape, copy or harvest My Stuff’s estimates, comparables or other content in bulk, or access the service by automated means other than the app;
- get around the scan allowances, reverse-engineer or disrupt the service, try to access other people’s data, or use My Stuff to build a competing product or dataset.
Your content
Your photos, notes and records are yours. You give us a limited permission to store, copy and process them, and to send them to our service providers, only to provide My Stuff to you as the privacy policy describes. The permission ends when you delete the content or your account, apart from copies that remain in backups for the limited time the privacy policy states. You confirm that you have the right to upload what you add. You may use the identifications, estimates and listing drafts My Stuff produces for you as you like; similar results may be produced for other people with similar items.
Our service and intellectual property
The app, this website and their content, apart from your content, are owned by Kaine Ventures, LLC and its licensors. We give you a personal, non-exclusive, non-transferable license to use the app on Apple devices you own or control, as the App Store terms permit. The names, logos and listings of marketplaces and other websites that appear among comparables belong to their owners; My Stuff links to them so you can check an estimate.
Suspension and ending
You can stop using My Stuff and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, after telling you why, unless the law or safety prevents it. If we ever discontinue My Stuff, we will give you reasonable notice and time to export your data.
Warranty and liability
We work to keep My Stuff useful and available, but it is provided as it is: estimates and identifications can be wrong, and the service can be interrupted. To the extent the law allows, we disclaim implied warranties, we are not liable for indirect or consequential losses such as a lower sale price or a lost sale, and our total liability to you is limited to the amount you paid for My Stuff in the twelve months before the claim.
If you are a consumer in the European Union, the European Economic Area or the UK, you keep your statutory rights, including the rights that apply when digital content or a digital service is not as described, and the limits above apply only as far as your local law allows. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or intent, or any other liability that cannot be limited by law.
Apple
These terms are between you and Kaine Ventures, LLC, not Apple. Apple is not responsible for My Stuff or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to the app, including product liability, legal compliance or intellectual property claims. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to a US Government embargo and are not on a US Government list of prohibited or restricted parties.
Law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. If you are a consumer in the European Union, the European Economic Area, the UK or another country whose law gives you mandatory protections, you keep them, and you may bring a claim in the courts of the country where you live. Before going to court, please contact us: most problems are solved quickly by email.
Changes
If we change these terms in a way that matters, we will tell you in the app or by email before the change applies. If you don’t accept the change, you can stop using My Stuff and delete your account. The date at the top shows the latest version.
